Interviewer: If I have a prior arrest or conviction, can you get my record sealed or expunged?
AZ Criminal Law Team Lawyer: If you have a conviction on your record you can, in Arizona, do what’s called a set aside and that means that rather than have it stated that you plead guilty to such and such, it just says that the judgment was set aside.
Case History: An Example of a Criminal Case with a Favorable Outcome
Interviewer: Can you share a story about case that was your favorite victory in defending a criminal case, maybe an unexpected victory or crazy case that kind of sticks out?
AZ Criminal Law Team Lawyer: Well, one of my favorite cases is I recently handled a felony aggravated DUI. The client was in the driveway of his house and the police came up to him, found the keys in the ignition and they charged him with a DUI. He was in his car, listening to the radio.
Well, they picked him up for DUI and charged him with it and we won on the case because there was no actual physical control of the vehicle. We also found out that the officers had not told the truth about a couple of issues with the case and that came out at trial.
My client was looking at 10 to 15 years, and after trial the jury found him not guilty and he walked away a free person.

Interviewer: At this point, I was going to say if there’s anything that you would like to share about criminal law that we haven’t covered that you would like to talk about?

I don’t charge for a consultation so it’s always a good idea to come in and meet with an attorney and get an idea what your case looks like. They should come in even just to find out if there are certain issues that you can fight because everyone has a fighting chance, and I believe that there are issues that exist in many cases. I would strongly recommend people consult an attorney when they are facing a criminal charge.
