Why Is It Crucial to Have A Private Attorney Work On An Assault Case?
A private attorney can gather information and figure out if there was any inconsistency or a lack of evidence so that all of the facts of the case can be put up as a defense. It will really help the case for an attorney to be able to put together a good defense if the person did not actually do the crime, although even if the person had actually done it, they can also do damage control and maybe get the client into anger management classes.
Is It Important To Disclose Information Like Prior Charges Or Convictions To The Attorney?
It is critically important that the person tell their attorney everything, because they could go in and be surprised by the prosecutor. Imagine if the attorney said was their client’s first time; he was just upset because his girlfriend was with her new boyfriend and they had a kid, but the prosecutor was able to point out that the couple had a history of domestic violence. By then, the attorney would not have much credibility left because it will look like they were not prepared or that the client was not being honest with their attorney.
What Qualifications Should Someone Look Out For When Choosing An Attorney?
They should look for experience; how long the attorney has handled criminal law, how familiar they were with the court or the prosecutor, whether they had many case in that court before and those sorts of things. They should also find out if the attorney is willing to go to trial and how many trials they had gone forward on when it came to assault charges; I actually go to trials quite often for my assault cases.
Some red flags to look out for would be if the attorney did not handle criminal law, if they had not been in that court, if they had never handled an assault charge or those sorts of things.
Will an Attorney Recommend Anger Management To Their Client?
This will depend on the case, although I generally don’t have my clients do it because I think it’s counterproductive to send them to anger management classes if we are trying to say they never did it in the first place. This will have to be decided on a case-by-case basis because, if the evidence is overwhelming, it may be a good idea to send them to anger management to show that they were taking it seriously or it was an accident or something on those lines.
